'We/us' means Fix the Fells, a partnership between The Tourism and Conservation Partnership, The National Trust and The Lake District National Park Authority working together to raise funds for upland footpath repair in the Lake District;

'Donation' means monetary value given by the user to support upland footpath repair in The Lake District.

You are permitted to access this Website in accordance with these Conditions and any donations must be made strictly in accordance with these Conditions. By continuing to browse through any part of the Website you are deemed to have accepted these Conditions. You may only use the Website for lawful purposes and in a lawful manner.

Donations
To donate money on this Website you must:
be over 18 years of age
provide your real name, email address and other order information required by us
provide payment details for a valid Credit or Switch/Debit Card issued in your name by a bank acceptable to us.
All monies are passed to The Tourism and Conservation Partnership, a not-for-profit organisation limited by guarantee. All proceeds are then forwarded to the Upland Footpath Restoration Project.
Unfortunately, as The Tourism and Conservation Partnership is not a charity, we cannot accept Gift Aid although this may change in the future.
Payment
By offering to make a Donation, you authorise us to transmit to and obtain information about you from third parties for the purposes of authentication of identity, validating your credit or switch/debit card, initial credit authorisation and authorisation of specific transactions. To protect the security of your credit card information, we employ the services of RBS WorldPay.
When submitting your donation you will be transferred from our site to a secure server of RBS WorldPay, who will authorise your credit card and take your payment. RBS WorldPay do not provide us with your credit card details.
All credit/debit card Donations are subject to validation checks and authorisation by the card issuer. In the event of refusal of authorisation by the card issuer, we will not be liable for any delay in the collection of your Donation. We will contact you as soon as possible if a Donation cannot proceed due to any problems with payment.
Refunds
As payments from this website are donations only, refunds will be considered exceptionally at the discretion of the management. Please contact us by emailing info@fixthefells.co.uk or by telephoning (015394) 34630 during office hours.
Privacy Policy
We take every precaution to ensure your personal details are safe and will not disclose any personal information that we receive to any organisation outside Fix the Fells for marketing purposes.
We will hold your personal information on our server and will use it as set out in these Conditions. Unless we are negligent, we shall not be held liable for any losses caused by authorised access to information provided by you.

These Conditions are governed by the laws of England. All disputes arising out of your access to this Website shall be subject to the sole and exclusive jurisdiction of the English courts. If any of the terms in these Conditions are deemed invalid or unenforceable for any reason then the invalid or unenforceable provisions shall be severed from these Conditions and the remainder shall continue to apply.
Entire Agreement
These Conditions constitute the whole agreement between You and Us and there are no promises, terms, conditions, obligations, representations or warranties, oral or written, expressed or implied, other than those contained herein. Save that this term shall not exclude liability for fraudulent misrepresentation or affect any statutory rights that you have as a consumer.
